The Food Industry Employers’ Union of Turkey (TÜGİS) continues to produce informative works by following the agenda of its members as well as union activities. In this context, TÜGİS signed a webinar in which the regulations regarding the Aged Retirement (EYT), which was accepted and enacted in the General Assembly of the Turkish Grand National Assembly, were evaluated in terms of employers. In the webinar where the coverage of EYT, the changes made, the support provided to the employer and post-retirement work were discussed, expert speakers on labor and social security law informed the participants. Speaking at the webinar, TÜGİS Chairman of the Board Kaan Sidar emphasized the importance of EYT for employers as well as employees, emphasizing the necessity of providing accurate information about the process and changes.

In the webinar where expert labor and social security law consultants from Mehmet Koçak Consulting Group took part as guests; Issues such as the coverage of EYT, the changes made, the support provided to the employer and post-retirement work were discussed. Providing information about the changes made in the Law No. 7438 at the event, Labor Law Specialist Ali Karaca said, “Employers cannot unilaterally terminate the contract of the worker within the scope of EYT. The application process of the worker within the scope of EYT should be discussed in the worker-employer partnership. Karaca, who also gave information about the fact that people who retired under EYT continue to work at the same workplace, said, “If the severance pay is paid in full to the person who will retire, if the person continues to work, without including the period before retirement into the account, by calculating the time elapsed as of the date of insurance start again, if the person continues to work. He may receive severance and notice pay. Ali Karaca also underlined that many factors are effective in the calculation of severance pay and that the calculations may vary according to the circumstances.
Those who retire with EYT will also receive the same pension!
Explaining the necessary conditions within the scope of EYT, Social Security Law Specialist Mehmet Gülpak said, “One of the necessary conditions within the scope of EYT is to have made a premium payment before 08.09. Gülpak said, “People who meet the conditions within the scope of EYT can make their applications in the long term. Those who cannot meet the conditions because the premium day has not expired can apply after the premium days have expired. Answering the question that employees who retire under EYT will receive a lower pension than other retirees, Gülpak stated that those who retire under EYT will also receive a pension at the same wage.
Support will be provided to employers within the scope of EYT
Social Security Transactions Specialist Eyüp Sabri Demirci drew attention to the points that employers should pay attention to in this process; “Even if the reason for the employee’s dismissal is selected incorrectly through the system, incentive support can be obtained if the mistake made by mistake is documented by applying to the SSI,” he said. Sharing the details of the support to be provided to employers by the state, Demirci pointed out that Law No. 6111 provides significant incentives to employers and conveyed the details of the scope of incentives. Demirci stated that the employer can benefit from incentives for its employees who retire under EYT as of March 3, 2023.
Energy, road and food support were discussed.
Social Security Specialist Mustafa Baştaş provided detailed information on energy, road and meal support and tax exemptions for these supports. Reminding that the use of meal card aids in markets was abolished in the latest tax exemption regulations, Baştaş warned that the cards should be closed for use in markets if employers want to take advantage of the exemption. Baştaş also said, “Employers can support the workers in the earthquake area or their first-degree relatives were affected by the earthquake disaster, with tax exemption up to 50 thousand TL.”
